Marketplace Terms
Effective November 5, 2026
These terms are an agreement between you and William Sweet, a sole proprietor doing business as BidLive ("BidLive", "we", "us"). By creating an account, listing, bidding or buying on BidLive, you agree to them. If you do not agree, do not use BidLive.
1. BidLive is a venue
BidLive is an online marketplace where people sell items to each other by Buy Now or live auction. BidLive is not the seller or the buyer of any item, does not own, hold, inspect or ship items, and is not a party to the sale between buyer and seller. Sellers are responsible for their listings and items. BidLive does not run in-person auctions or events.
2. Accounts
- You must be at least 18 years old and able to make a binding contract.
- Give accurate information and keep your login private. You are responsible for activity on your account.
- One person per account. We may suspend or close accounts that break these terms, are used for fraud, or put other users at risk.
3. Selling
- To sell you must set up a Stripe Express account through BidLive and be approved by Stripe. Payments to sellers are processed by Stripe and are subject to the Stripe Connected Account Agreement.
- You must own the item or have the right to sell it, describe it honestly (including flaws), use your own photos, and deliver it the way your listing says: shipped promptly with tracking, or handed over at local pickup.
- A Buy Now sale or a winning auction bid is a binding sale. You may cancel a listing only while it has no bids and is not in checkout.
- You are responsible for any taxes on your sales and for following the law where you live.
4. Buying and bidding
- Buy Now: the item is held for you for about 30 minutes while you pay through Stripe Checkout. It is yours once payment goes through.
- Auctions: you must save a card before bidding. Every bid is a binding offer. When an auction ends, the highest bidder's saved card is charged the winning bid, plus shipping if the item ships, without any further step. If that charge fails, the item may go to the next-highest bidder, and repeated failed charges can get your account suspended.
- Bids must beat the current bid by at least $1, or $5 once the bid is above $100. A bid in the last 30 seconds adds 30 seconds to the clock. Bids cannot be withdrawn.
- You pay exactly the price or winning bid, plus any shipping shown. Buyers pay no BidLive fee.
- For local pickup, meet in a safe public place. BidLive is not responsible for meetings between users.
5. Fees
- Sellers pay a BidLive fee of 10% of the item price (Buy Now price or winning bid) when an item sells. There is no fee on shipping charges, no listing fee and no monthly fee.
- Card processing fees are paid by BidLive out of its 10%. The seller receives the price minus 10%, plus any shipping charged.
- Payouts reach your bank on the schedule set in your Stripe account. If a sale is refunded, the buyer gets the full amount back: the seller's share is reversed and BidLive refunds its fee.
- We may change fees for future listings with notice on the site. Fees on a listing are the ones in effect when it was posted.
6. Buyer protection
- If an item never arrives (or you could not pick it up), or it is significantly not as described, report it from My orders. You can report it any time before you confirm you received it, and for 7 days after you confirm.
- BidLive reviews the claim and may ask both sides for information, photos or tracking. BidLive decides claims in its discretion. If we approve a claim, we refund the buyer through Stripe, which pulls the seller's share back from the seller's Stripe balance. We may require the item to be returned first.
- Buyer protection does not cover buyer's remorse, items accurately described, damage after delivery, or deals made outside BidLive.
- If you also open a dispute with your card issuer, that process replaces BidLive's claim review.
- Payments for a sale go to the seller's Stripe account when the buyer pays; BidLive does not hold funds until delivery. Sellers must keep enough in their Stripe balance to cover refunds and chargebacks on their sales, and owe BidLive any amount it covers for them.
7. Prohibited items
You may not list or sell:
- Firearms, ammunition, gun parts, explosives, fireworks, and weapons such as switchblades or brass knuckles
- Alcohol, tobacco, vaping products, marijuana and CBD products, illegal drugs and drug paraphernalia
- Prescription drugs, medical devices that need a prescription, and recalled items
- Live animals, animal parts from protected species, and human remains or body parts
- Counterfeit, replica or stolen goods, and anything that infringes someone's copyright or trademark
- Adult content and sexual services
- Hazardous materials, chemicals and pesticides
- Gift cards, cash, coupons, tickets sold above face value where the law forbids it, and financial products or cryptocurrencies
- Government IDs, badges, uniforms, licenses, and personal information
- Services, digital-only goods, real estate, and motor vehicles
- Anything illegal to sell in the buyer's or seller's state, or items Stripe does not allow (see Stripe's restricted list)
We may remove any listing and cancel any sale that breaks these rules, and refund the buyer.
8. Conduct
No shill bidding (bidding on your own items or with friends to raise the price), fake listings, harassment, or moving a BidLive sale off BidLive to avoid fees. Do not interfere with the site, scrape it, or use it for anything illegal.
9. Disclaimers and limits
BidLive is provided "as is". We do not promise that the site will always be available or error-free, and we do not guarantee any item, user, listing or sale. To the extent the law allows, BidLive's total liability to you for any claim is limited to the fees BidLive received from your sales in the 12 months before the claim, or $100 if greater, and BidLive is not liable for indirect or consequential losses. Some states do not allow these limits, so they may not apply to you.
10. Disputes between users
Try to settle problems with the other user first. You release BidLive from claims arising out of disputes between users, except for BidLive's own obligations under buyer protection.
11. Changes and contact
We may update these terms. We will post the new version here with a new date, and continued use means you accept it. These terms are governed by the laws of the State of New York. Questions: william.sweet@rocketmail.com.
